فى الأحوال التى ترتكب فيها الجريمة بواسطة شخص اعتبارى يعاقب المسئول عن
الإدارة الفعلية للشخص الاعتبارى المخالف بذات العقوبات المقررة على الأفعال التى
ترتكب بالمخالفة لأحكام هذا القانون ، متى ثبت علمه بها ، وكانت الجريمة قد وقعت بسبب
إخلاله بواجبات الوظيفة .
ويكون الشخص الاعتبارى مسئولا بالتضامن معه عن الوفاء بما يحكم به من عقوبات
مالية وتعويضات ، إذا كانت الجريمة قد ارتكبت من أحد العاملين به باسمه نيابة عنه .
