تفصل المحكمة الجزئية في أيلولة الأرض غير القابلة للتجزئة من يحترف الزراعة من ذوي الشأن ، فإن تساووا في هذه الصفة اقترع بينهم .
على أنه إذا كان سبب كسب الملكية الميراث فضل من يشتغل بالزراعة من الورثة فإن تساووا في هذه الصفة قدم الزوج فالولد فإذا تعدد الأولاد اقترع بينهم .
