إذا اقتضى التحقيق الاستعانة بخبير وجب على عضو النيابة العامة أن يصدر أمرا بندبه يفصل فيه المهمة التي يكلف بها، ويحلف الخبير اليمين أمام عضو النيابة العامة بأن يؤدي عمله بالأمانة والصدق ما لم يكن من فئات الخبراء الذين سبق أن أدوا اليمين قبل مزاولة أعمال الخبرة.
