لا يجوز للنيابة العامة تفتيش غير المتهم أو غير منزله إلا إذا اتضحت دلائل قوية أنه حائز لأشياء تتعلق بالجريمة وتفيد في كشف الحقيقة.
ويشترط لاتخاذ هذا الإجراء الحصول مقدما على إذن من القاضي الجزئي، ويصدر القاضي هذا الإذن بعد الاطلاع على الأوراق والتحقيقات.
