إذا فقدت أوراق التحقيق كلها أو بعضها قبل صدور قرار فيه، يعاد التحقيق فيما فقدت أوراقه.
وإذا كانت القضية مرفوعة أمام المحكمة، تتولى هي إجراء ما تراه من التحقيق، ولها إرسال الأوراق إلى النيابة العامة أو قاضي التحقيق بحسب الأحوال، لإعادة التحقيق فيما فقدت أوراقه إذا رأت محلا لذلك.
