استثناء من أحكام هذا الكتاب، يجوز لرئيس الجمهورية بناء على عرض النائب العام وبعد موافقة مجلس الوزراء، الموافقة على تسليم المتهمين ونقل المحكوم عليهم إلى دولهم، وذلك لمحاكمتهم أو تنفيذ العقوبة المقضي بها عليهم بحسب الأحوال، متى اقتضت مصلحة الدولة العليا ذلك.
