يجوز للنيابة العامة أن تطلب من الجهة القضائية الأجنبية تسليم المتهم أو المحكوم عليه، وفي حالة رفض التسليم لها أن تطلب محاكمته وفقا لقانون الدولة المطلوب منها، ويجوز للنيابة العامة أن تصدر أمرا مسببا بالقبض على المطلوب تسليمه، وتعتبر مدة حبسه التي تمت بالخارج مدة حبس احتياطي في شأن تطبيق قواعد تنفيذ العقوبة.
