لا يجوز التفتيش إلا للبحث عن الأشياء الخاصة بالجريمة الجاري جمع الاستدلالات أو حصول التحقيق بشأنها.
ومع ذلك إذا ظهر عرضا أثناء التفتيش وجود أشياء تعد حيازتها جريمة، أو تفيد في كشف الحقيقة في جريمة أخرى، يجوز لمأمور الضبط القضائي أن يضبطها.
