تقدم الشكوى ممن له الولاية على المجني عليه إذا لم يبلغ خمس عشرة سنة كاملة، أو كان مصابا باضطراب نفسي أو عقلي.
وإذا كانت الجريمة واقعة على المال، تقبل الشكوى كذلك من الوصي أو القيم.
وتسري جميع الأحكام الخاصة بالشكوى على الحالات المشار إليها بالفقرتين الأولى والثانية من هذه المادة.
