تنظر المحكمة الطلب وتفصل فيه في غرفة المشورة، ويجوز لها سماع أقوال النيابة العامة والطالب، كما يجوز لها استيفاء كل ما تراه لازما من المعلومات.
ويكون إعلان الطالب بالحضور قبل الجلسة بثمانية أيام على الأقل.
ولا يقبل الطعن في الحكم إلا بطريق النقض لخطأ في تطبيق القانون أو في تأويله، وتتبع في الطعن الأوضاع والمواعيد المقررة للطعن بطريق النقض في الأحكام.
