إذا حكم بالغرامة وما يجب رده والتعويضات والمصاريف معا، وكانت أموال المحكوم عليه لا تفي بذلك كله، وجب توزيع ما يتحصل منها بين ذوي الحقوق على حسب الترتيب الآتي:
(أولا) المصاريف المستحقة للدولة.
(ثانيا) المبالغ المستحقة للمدعي المدني.
(ثالثا) الغرامة وما تستحقه الحكومة من الرد والتعويض.
