للنيابة العامة في الأحوال التي يجوز فيها تأجيل تنفيذ العقوبة على المحكوم عليه أن تطلب منه تقديم كفالة بأنه لا يفر من التنفيذ عند زوال سبب التأجيل، ويقدر مبلغ الكفالة في الأمر الصادر بالتأجيل.
ولها أيضا أن تشترط لتأجيل التنفيذ ما تراه من الاحتياطات الكفيلة بمنع المحكوم عليه من الهرب.
