الأحكام التي تصدر في موضوع الدعوى بناء على إعادة النظر من غير محكمة النقض، يجوز الطعن فيها بجميع الطرق المقررة في القانون.
ولا يجوز أن يقضى على المتهم بأشد من العقوبة السابق الحكم بها عليه.
