يجب على مأمور الضبط القضائي أن يبلغ فورا المتهم المضبوط بسبب تقييد حريته، وبالتهم المنسوبة إليه، وأن يسمع أقواله، وأن يحيطه بحقوقه كتابة، وأن يمكنه من الاتصال بذويه وبمحاميه.
وإذا لم يأت المتهم بما ينفي التهمة عنه، يرسله مأمور الضبط القضائي خلال أربع وعشرين ساعة من وقت تقييد حريته إلى سلطة التحقيق المختصة.
