يسقط الاستئناف المرفوع من المحكوم عليه بعقوبة مقيدة للحرية واجبة النفاذ إذا لم يتقدم للتنفيذ قبل الجلسة التي تنظر فيها الدعوى.
ومع ذلك فللمحكمة عند نظر الاستئناف أن تأمر بوقف تنفيذ العقوبة مؤقتا أو الإفراج عن المحكوم عليه بكفالة أو بغيرها، وذلك إلى حين الفصل في الاستئناف.
