يكون تكليف المتهم والشهود بالحضور أمام محكمة جنايات أول درجة قبل الجلسة بعشرة أيام كاملة على الأقل.
وفي الأحوال التي يكون فيها استئناف الحكم من النيابة العامة، يكون إعلان المتهم بالاستئناف والحضور أمام محكمة الجنايات المستأنفة قبل الجلسة بعشرة أيام كاملة على الأقل.
ولا تتصل المحكمة بالدعوى إلا بإعلان المتهم بأمر الإحالة.
