إذا وقع خطأ مادي في حكم أو في أمر صادر من جهات التحقيق أو المحاكمة ولم يكن يترتب عليه البطلان، تتولى الجهة التي أصدرت الحكم أو الأمر تصحيح الخطأ من تلقاء نفسها أو بناء على طلب أحد الخصوم وذلك بعد تكليفهم بالحضور.
ويقضى بالتصحيح في غرفة المشورة بعد سماع أقوال الخصوم، ويؤشر بالأمر الذي يصدر على هامش الحكم أو الأمر.
ويتبع هذا الإجراء في تصحيح اسم المتهم ولقبه.
