Article 326 of the Criminal Procedure Law (2025)

يرفض القاضي إصدار الأمر إذا رأى:
(أولا) إنه لا يمكن الفصل في الدعوى بحالتها التي هي عليها أو دون تحقيق أو مرافعة.
(ثانيا) أن الواقعة نظرا لسوابق المتهم أو لأي سبب آخر تستوجب توقيع عقوبة أشد من الغرامة التي يجوز صدور الأمر بها.
ويصدر القاضي قراره بالرفض بتأشير على الطلب الكتابي المقدم له ولا يجوز الطعن في هذا القرار.
ويترتب على قرار الرفض إعادة الأوراق للنيابة العامة لاتخاذ ما يلزم فيها.
