يجوز للقاضي من تلقاء نفسه عند نظر إحدى الجنح المبينة في المادة ٣٢٣ من هذا القانون أن يصدر فيها أمرا جنائيا، وذلك إذا تغيب المتهم عن الحضور رغم إعلانه، ولم تكن النيابة العامة قد طلبت توقيع أقصى عقوبة.
