إذا امتنع الشاهد عن أداء اليمين أو عن الإجابة في غير الأحوال التي يجيز له القانون فيها ذلك، حكم عليه في مواد الجنايات والجنح بغرامة لا تجاوز ألفى جنيه.
وإذا عدل الشاهد عن امتناعه قبل إقفال باب المرافعة يعفى من العقوبة المحكوم بها عليه كلها أو بعضها.
