تنقضي الدعوى المدنية بمضي المدة المقررة في القانون المدني، ومع ذلك لا تنقضي بالتقادم الدعوى المدنية الناشئة عن الجرائم المنصوص عليها في الفقرة الثانية من المادة ١٧ من هذا القانون.
وإذا انقضت الدعوى الجنائية بعد رفعها لسبب من الأسباب الخاصة بها فلا تأثير لذلك في سير الدعوى المدنية المرفوعة معها.
