مع عدم الإخلال باختصاصات رئيس الجمهورية في العفو عن العقوبة أو تخفيفها، يجوز لورثة المجنى عليه أو وكيلهم الخاص إثبات الصلح في أية حالة كانت عليها الدعوى إلى أن يصدر فيها حكم بات في الجرائم المنصوص عليها في المواد ٢٣٠، ٢٣٣، ٢٣٤/ (الفقرتين الأولى والثانية)، ٢٣٥، ٢٣٦/ (الفقرة الأولى) من قانون العقوبات، ويترتب على الصلح في هذه الحالة تخفيف العقوبة وفقا لحكم المادة ١٧ من قانون العقوبات.
