إذا رأى قاضي التحقيق أن الواقعة جناية أو من الجنح التي تقع بواسطة الصحف أو غيرها من طرق النشر عدا الجنح المضرة بأفراد الناس، وأن الأدلة على المتهم كافية يحيل الدعوى إلى محكمة جنايات أول درجة، ويكلف النيابة العامة بإرسال الأوراق إليها فورا.
