يرسل قاضي التحقيق الأوراق إلى النيابة العامة بعد انتهاء التحقيق، وعليها أن تقدم له طلباتها كتابة خلال ثلاثة أيام إذا كان المتهم محبوسا أو خاضعا لأحد التدابير، وعشرة أيام إذا كان مفرجا عنه.
وعلى قاضي التحقيق أن يخطر باقي الخصوم لإبداء ما لديهم من أقوال خلال ثلاثة أيام من تاريخ إخطارهم.
