إذا رفض الاستئناف المرفوع من المدعي بالحقوق المدنية عن الأمر الصادر بأن لا وجه لإقامة الدعوى جاز للجهة المرفوع إليها الاستئناف أن تحكم عليه لصالح المتهم بالتعويضات الناشئة عن رفع الاستئناف إذا كان لذلك محل.
