يتعين الفصل في استئناف أوامر الحبس الاحتياطي أو مده أو الإفراج المؤقت، خلال ثمان وأربعين ساعة من تاريخ رفع الاستئناف، وإلا وجب الإفراج عن المتهم إذا كان الاستئناف على قرار الإفراج المؤقت.
وتخصص دائرة أو أكثر من دوائر المحكمة الابتدائية أو محكمة الجنايات بدرجتيها لنظر استئناف أوامر الحبس الاحتياطي أو الإفراج المؤقت المشار إليهما في هذه المادة.
