مع مراعاة أحكام المادة ١٣٢ من هذا القانون، يفصل عضو النيابة العامة المختص في القرار أو الأمر الصادر بالإحالة إلى المحكمة الجزئية أو محكمة جنايات أول درجة في استمرار حبس المتهم احتياطيا أو الإفراج عنه أو في القبض عليه إذا لم يكن قد قبض عليه أو كان قد أفرج عنه، ما لم يكن قد أعلن بقرار أو أمر الإحالة، فإذا قبض عليه تعين عرضه خلال ثمان وأربعين ساعة على المحكمة المختصة.
