يجوز لمحكمة الموضوع أو محكمة الجنح المستأنفة منعقدة في غرفة المشورة أن تحيل الأمر في شأن الرد إلى المحكمة المدنية إذا رأت موجبا لذلك، وفي هذه الحالة يجوز وضع الأشياء المضبوطة تحت الحراسة أو اتخاذ إجراءات تحفظية أخرى نحوها.
