يجوز الأمر بالرد ولو من غير طلب.
ولا يجوز للنيابة العامة أو قاضي التحقيق الأمر بالرد عند المنازعة، ويرفع الأمر في هذه الحالة أو في حالة وجود شك فيمن له الحق في تسلم الشيء إلى محكمة الجنح المستأنفة منعقدة في غرفة المشورة، بناء على طلب ذوي الشأن لتأمر بما تراه.
