يكون رد الأشياء المضبوطة إلى من كانت في حيازته وقت ضبطها، أما الأشياء التي وقعت عليها الجريمة أو المتحصلة منها فيكون ردها إلى من فقد حيازتها بالجريمة، ما لم يكن لمن ضبطت معه الحق قانونا في حبسها.
