يجوز للقاضي الجزئي أو محكمة الجنح المستأنفة أو المحكمة المختصة تقدير كفالة للإفراج عن المتهم كلما طلبت النيابة العامة الأمر بمد مدة الحبس الاحتياطي، وتراعى في ذلك أحكام المواد ١٢٧، ١٢٨، ١٢٩، ١٣٠، ١٣١ من هذا القانون.
