تسرى فى شأن جرائم الصلح الواقى من الإفلاس الأحكام الآتية :
١ - يعاقب المدين بالحبس مدة لاتقل عن ستة أشهر إذا :
(أ) أخفى بسوء نية كل أمواله أو بعضها أو غالى فى تقديرها بقصد الحصول على الصلح .
(ب) ترك بسوء نية دائنا بدين وعمى أو ممنوعا أو مغالى فى دينه يشترك فى مداولات الصلح والتصويت عليها أو مكنه من ذلك .
( ج) أغفل بسوء نية ذكر دائن فى قائمة الدائنين .
٢ - يعاقب الدائن بالعقوبة المنصوص عليها بالفقرة السابقة إذا اشترك بسوء نية فى مداولات الصلح والتصويت عليه وهو ممنوع من هذا الاشتراك ، أو كان دينه مغالى فيه ، أو قرر له المدين أو أى شخص آخر مزايا خاصة مقابل تصويته مع الصلح .
٣ - يعاقب بالحبس مدة لاتقل عن ستة أشهر أمين الصلح الذى قدم أو أقر بسوء نية بيانات غير صحيحة عن حالة المدين .
