١ - إذا فسخ عقد البيع بحكم أو بمقتضى شرط فى العقد قبل صدور الحكم بشهر إفلاس المشترى ، جاز للبائع استرداد البضائع كلها أو بعضها فى التفليسة بشرط أن توجد عينا .
٢ - ويجوز الاسترداد ولو وقع الفسخ بعد صدور حكم شهر الإفلاس بشرط أن [غير مقروء]
دعوى الاسترداد أو دعوى الفسخ قد رفعت قبل صدور هذا الحكم .
