الدائنون المرتهنون أو الممتازون أو أصحاب حقوق الاختصاص الذين لايحصلون على شىء من ثمن العقارات التى تقع عليها تأميناتهم يعتبرون دائنين عاديين وتسرى عليهم بهذه الصفة جميع الآثار الناشئة عن أعمال جماعة الدائنين وعن الصلح القضائى إن وقع .
