١ - الوفاء بدين تجارى لمن يحوز سند الدين مؤشرا عليه بالتخالص أو لمن يحمل
مخالصة من الدائن أو من نائبه يبرئ ذمة المدين إلا إذا أثبت الدائن أن المدين لم يقم
بالتحرى الكافى للتحقق من صحة الوفاء .
٢ - وجود سند الدين فى حيازة المدين قرينة على براءة ذمته من الدين مالم يثبت
خلاف ذلك .
