١ - يشمل غل اليد جميع الأموال التى تكون ملكا للمفلس فى يوم صدور حكم شهر الإفلاس والأموال التى تؤول إليه ملكيتها وهو فى حالة إفلاس .
٢ - ومع ذلك لايشمل غل اليد ما يأتى :-
( أ ) الأموال التى لا يجوز الحجز عليها قانونا والإعانة التى تتقرر للمفلس .
(ب) الأموال المملوكة لغير المفلس .
(ج) الحقوق المتصلة بشخص المفلس أو بأحواله الشخصية .
(د ) التعويضات التى تستحق للمستفيد فى عقد تأمين صحيح أبرمه المفلس قبل صدور حكم شهر الإفلاس ومع ذلك يلتزم المستفيد بأن يرد إلى التفليسة جميع أقساط التأمين التى دفعها المفلس ابتداء من التاريخ الذى عينته المحكمة للتوقف عن الدفع مالم ينص القانون على غير ذلك .
