١ - يجوز للمحكمة بناء على طلب قاضى التفليسة أو النيابة العامة أو أمين التفليسة أو المراقب أن تأمر عند الاقتضاء بالتحفظ على شخص المفلس أو بمنعه من مغادرة البلاد لمدة محددة قابلة للتجديد . وللمفلس أن يتظلم من هذا الأمر دون أن يترتب على التظلم وقف تنفيذه .
٢ - وللمحكمة أن تقرر فى كل وقت إلغاء أمر التحفظ على شخص المفلس أو أمر المنع من مغادرة البلاد .
