يجوز للمفلس وللمراقب الاعتراض لدى قاضى التفليسة على أعمال أمينها قبل إتمامها . ويترتب على الاعتراض وقف إجراء العمل . ويجب أن يفصل قاضى التفليسة فى الاعتراض خلال خمسة أيام من تاريخ تقديمه . ويكون قرار قاضى التفليسة واجب النفاذ فورا .
