١ - تعين المحكمة فى حكم الإفلاس وكيلا لإدارة التفليسة يسمى « أمين التفليسة » .
٢ - ويجوز فى كل وقت لقاضى التفليسة من تلقاء نفسه أو بناء على طلب المفلس أو المراقب الأمر بإضافة أمين أو أكثر بشرط ألا يزيد عددهم على ثلاثة .
٣ - يصدر بتنظيم مهنة أمناء التفليسات قرار من الوزير المختص .
