١ - إذا طلبت النيابة العامة شهر إفلاس التاجر أو إذا رأت المحكمة شهر إفلاسه من تلقاء ذاتها وجب على قلم الكتاب أن يعلنه بيوم الجلسة .
٢ - في حالة وفاة التاجر أو اعتزاله التجارة لا يجوز للمحكمة أن تنظر في شهر إفلاسه من تلقاء ذاتها أو بناء على طلب النيابة العامة بعد انقضاء الميعاد المشار إليه في الفقرة الأولى من المادة ٥٥١ من هذا القانون .
