١ - يتحمل المسحوب عليه وحده الضرر الذى يترتب على وفاء شيك زور فيه توقيع الساحب أو حرفت فيه بياناته إذا لم يمكن نسبة أى خطأ إلى الساحب . وكل شرط على خلاف ذلك يعتبر كأن لم يكن .
٢ - ويعتبر الساحب مخطئا على وجه الخصوص إذا لم يبذل فى المحافظة على دفتر الشيكات المسلم إليه عناية الشخص العادى .
٣ - ولا يلتزم المسحوب عليه بالتحقق من صحة توقيعات المظهرين أو الضامنين الاحتياطيين ولايسأل عن تزويرها .
