١ - تبرأ ذمة البنك قبل المستفيد إذا لم يصله خلال مدة سريان خطاب الضمان طلب من المستفيد بالدفع إلا إذا اتفق صراحة على تجديد تلك المدة تلقائيا أو وافق البنك على مدها .
٢ - يلتزم البنك بأن يرد للآمر فى نهاية مدة سريان خطاب الضمان ما قدمه من تأمين للحصول على هذا الخطاب .
