إذا كان العقد تجاريا بالنسبة إلى أحد طرفيه ، فلا تسرى أحكام القانون التجارى
إلا على التزامات هذا الطرف وحده ، وتسرى على التزامات الطرف الآخر أحكام القانون
المدنى ما لم ينص القانون على غير ذلك .
