١ - الوكالة بالعمولة للنقل عقد يلتزم بمقتضاه الوكيل بأن يبرم باسمه ولحساب موكله
عقدا لنقل أشياء أو عقد نقل أشخاص وبأن يقوم عند الاقتضاء بالعمليات المرتبطة بهذا النقل .
٢ - إذا تولى الوكيل بالعمولة النقل بوسائله الخاصة اعتبر ناقلا وتسرى عليه أحكام
عقد النقل .
