١ - يجوز للوكيل بالعمولة أن يصرح باسم الموكل الذى يتعاقد لحسابه إلا إذا طلب [غير مقروء] الموكل عدم الإفضاء باسمه . ولايترتب على الإفضاء باسم الموكل تغيير فى طبيعة الوكالة مادام الوكيل يبرم العقد باسمه .
٢ - على الوكيل بالعمولة الإفضاء إلى الموكل باسم الغير الذى تعاقد معه إذا طلب الموكل منه ذلك فإذا امتنع الوكيل بالعمولة عن الإفضاء باسم الغير دون مسوغ مقبول جاز اعتباره ضامنا تنفيذ الصفقة .
