لايجوز للخبير المثمن أن يمتنع عن إرساء المزايدة إلا فى الحالتين الآتيتين :
( أ ) إذا اقتصرت المزايدة على السلعة على شخص واحد .
(ب ) إذا لم تصل نتيجة المزايدة إلى الثمن الأساسى .
