١ - يجوز الاتفاق على إلزام المشترى بعدم التخفيض عن ثمن معين عند إعادة البيع إذا كان المبيع سلعة تحمل عليها علامة تجارية مسجلة تميزها ، ويجوز للمحكمة أن تقضى ببطلان هذا الشرط إذا كان المبيع من السلع الضرورية للاستهلاك الشعبى .
٢ - لايلتزم خلفاء المشترى بمراعاة الشرط المشار إليه فى الفقرة السابقة إلا إذا علموا به أو كان فى مقدورهم العلم به .
