ترفع النيابة الدعوى التأديبية من تلقاء نفسها أو متى طلب ذلك مجلس النقابة أو رئيس محكمة النقض أو رئيس المحكمة الادارية العليا أو رئيس محكمة استئناف أو رئيس محكمة القضاء الادارى أو رئيس محكمة ابتدائية أو رئيس محكمة ادارية .
