يجوز لرئيس الجمهورية في المناطق التي تخضع لنظام قضائي خاص أو بالنسبة لقضايا معينة أن يأمر بتشكيل دوائر أمن الدولة المنصوص عليها في المادة السابقة من الضباط وتطبق المحكمة في هذه الحالة الإجراءات التي ينص عليها رئيس الجمهورية في أمر تشكيلها.
وتشكل دائرة أمن الدولة العليا في هذه الحالة من ثلاثة من الضباط القادة ويقوم أحد الضباط أو أحد أعضاء النيابة بوظيفة النيابة العامة.
