عند انتهاء حالة الطوارئ تظل محاكم أمن الدولة مختصة بنظر القضايا التي تكون محالة عليها وتتابع نظرها وفقا للإجراءات المتبعة أمامها.
أما الجرائم التي يكون المتهمون فيها قد قدموا إلى المحاكم فتحال إلى المحاكم العادية المختصة وتتبع في شأنها الإجراءات المعمول بها أمامها.
